Five years on spa shell structure: The spa shell structure is warranted against water loss due to defects in materials or workmanship for five (5) years from the original date of purchase.*
Five years on spa shell surface: The acrylic spa shell is warranted against cracking, blistering or delaminating due to defects in materials or workmanship for five (5) years from the original date of purchase.* Normal wear or physical damage are not covered under this warranty.
Two years on spa plumbing: Spa fittings and plumbing are warranted against leaks due to defects in materials or workmanship for two (2) years from the original date of purchase.*
Two years on standard spa equipment - Electronic spa control systems, jet pump(s), circulation pump and heater: The spa equipment systems are warranted against failure due to defects in materials or workmanship for two (2) years from the date of purchase.*
One year on spa cabinet: The spa cabinet is warranted to be free from defects in materials or workmanship for one (1) year from the original date of purchase.* This warranty does not include damage caused in delivery, misuse or accident. Variations in colour, normal wear or appearance are not covered under this warranty as all materials react differently to environmental conditions.
Ninety days on spa pillows and filter box: Pillows and filter box are subject to water chemistry variation and are warranted to be free from defect in materials or workmanship for ninety (90) days from the original date of purchase.*
Spa covers: Spa covers are warranted to be free from defects in materials and workmanship for a period of one (1) year on vinyl and one (1) year on foam core from the original date of purchase.*
Spa accessories: Spa accessories such as cover lifters are specifically excluded under this warranty but may be covered by the accessory manufacture. Please see the respective product manufacturers warranty for details.
Other warranties: All wearable, factory-installed components, including but not limited to, ozonators, pump seals, jet internals, all molded plastic fittings, topside overlays, LED lighting, UV systems and audio equipment are warranted against failure due to defects in workmanship and materials for a period of one (1) year from the date of purchase* and are subject to parts exchange only.
Notify your authorized Sparkling Mountain Spas dealer in the event of a defect covered under the terms of this limited warranty. Use all reasonable means to protect the spa from further damage. A Sparkling Mountain Spas service representative will repair the defect subject to the terms and conditions contained in this limited warranty upon proof of purchase. Parts and labour to repair the defect will be supplied at no charge. There is no labour coverage for time required to gain access to the spa and you may be assessed a reasonable travel charge for the service call. Sparkling Mountain Spas, in its sole discretion, reserves the right to provide a replacement spa of equal value. In such an event, reasonable costs for removal of the original spa and delivery and installation of the replacement spa will be the sole responsibility of the owner. Sparkling Mountain Spas reserves the right to inspect any warranty claim on-site or at its’ manufacturing facility as deemed necessary.
This limited warranty is extended to the original purchaser of the Sparkling Mountain Spa and terminates upon any transfer of ownership. This limited warranty does not provide coverage for any accessory attached to, or installed on the spa after the date of manufacture. This limited warranty is void if the spa has been subjected to any misuse, abuse, neglect, alteration, freeze conditions, improper installation, improper water chemistry or water maintenance or if repairs have been attempted by anyone other than an authorized Sparkling Mountain Spas service representative; or if failure or damage is caused by accident, acts of god or any other causes beyond the control of the manufacturer. Neglect, abuse and misuse includes any installation, operation or maintenance of the spa other than outlined in the Owner’s Manual or use for which the spa is not designed; including, but not limited to, leaving the spa uncovered while it is void of water or not in use, damage caused by the improper use of chemicals such as PH, calcium hardness, total alkalinity or sanitizer; failure to maintain proper water chemistry and chemical balance, damage caused by the use of abrasive cleaners, operation of the spa outside the range of 35°F and 104°F (2°C to 40°C), failure to provide even and sufficient foundation for the spa, improper handling of the spa during transportation, installation and set-up. Fading, discolouration, yellowing, scratches and/or gouges are considered normal wear and tear and are not warrantable defects if reported after the date of installation. Commercial use of the spa is not covered by this warranty whatsoever.
In no event, shall Sparkling Mountain Spas, its authorized representatives or employees be held liable for any injury, loss of use of your spa, cost or other damage, whether incidental or consequential, however it shall arise. The liability of Sparkling Mountain Spas, in no event, for any reason or cause, shall exceed the original amount paid to Sparkling Mountain Spas for the product. Coverage under this limited warranty shall commence on the original date of purchase and the duration of such coverage shall never extend the stated time periods for any reason whatsoever. No other warranties expressed or implied are valid. Some provinces do not allow the exclusion of incidental or consequential damages, so the above limitations may not apply to you.
This limited warranty gives you specific legal rights and does not apply if it interferes with any law or regulation in any province.
